Data Collection Terms, Personal Information Protection, and Consumer Welfare

How to reconcile data collection with personal information protection has become a major issue in the digital economy era. From the perspective of consumer welfare, this paper discusses whether firms should be restricted from mandating the collection of consumer data. By modeling the benefits and costs to firms and consumers under different types of data collection terms, the paper finds that, in the absence of regulation under personal information protection laws, firms choose data collection terms based on the marginal private and marginal public benefits of data. Welfare analysis shows that, compared with voluntary collection terms, mandatory collection terms may increase consumer welfare by enhancing the public benefits of data, even though they entail restrictions on consumers' individual rights. The paper then examines how the regulation of mandatory collection terms under personal information protection laws affects consumer welfare. It finds that less stringent enforcement can achieve Pareto improvements in consumer welfare in certain data collection scenarios, whereas excessively stringent enforcement does not help achieve such improvements. The policy implication is that the market-oriented reform of data as a factor of production should continue, and restrictions on data collection terms should be appropriately relaxed.

Abstract

如何协调数据收集与个人信息保护之间的关系已成为数字经济时代的重大议题。本文从消费者福利的角度,讨论是否应该限制企业强制收集消费者数据。通过建模刻画企业与消费者在不同类型数据收集条款下的收益与成本,本文发现当不受个人信息保护法律规制时,企业将根据数据边际私人收益和边际公共收益来选择数据收集条款。而福利分析表明,相比于自愿收集条款,虽然强制收集条款意味着消费者个人权利受限,但可能通过提高数据公共收益来增加消费者福利。随后本文讨论个人信息保护法律对强制收集条款的规制如何影响消费者福利,并发现实施力度较弱的规制可以在某些数据收集场景中实现消费者福利帕累托改进,而过强的规制力度无助于实现消费者福利的帕累托改进。本文的政策启示是,应当继续推进数据要素的市场化改革,并适当放松对数据收集条款的规制力度。
